Please read these Terms & Conditions ("T&C") carefully before registering for the Nuvoco Sauthi Khaas Garba campaign ("Campaign") organized by D. B. Corp Limited, in association with Nuvoco Vistas Corporation Limited ("Nuvoco")
By registering or participating, the person submitting the registration ("Registered Participant") and the members of the registered Garba group ("Participants") confirm that they have read, understood and agreed to these T&C.
Participation is voluntary and does not require any purchase, subscription fee or payment.
1. Eligibility and Registration
1.1. The Campaign is open to eligible Garba groups meeting the criteria communicated by the Organizers. All Participants must be 18 years or above and legally competent to participate.
1.2. The person submitting the registration must be authorised by the group and shall provide complete and accurate information. Registration may be made through WhatsApp, the Campaign microsite or any other platform specified by the Organizers.
1.3. Participants shall provide identity/age proof, including Aadhar or another government-issued document, and PAN and other documents where required for verification, Prize payment or tax compliance. The Organizers may request masked Aadhar or another legally permissible form of verification.
1.4. The Organizers may verify information and documents at any stage. False, incomplete, misleading or unverifiable information may result in disqualification.
1.5. Registration or submission of a video does not guarantee selection or participation. The Organizers may review, shortlist and select groups based on the Campaign criteria.
2. Video and Content
2.1. The submitted video must be an authentic recording of the registered Garba group. The Participant confirms that all necessary rights and permissions have been obtained for its submission and use. Any use of Artificial Intelligence in the video shall be disqualified or if mistakenly chosen as winner, the same will be cancelled.
2.2. The Registered Participant shall obtain the necessary consent from every person appearing or identifiable in the video and shall ensure that they are informed about the uses contemplated under these T&C. The Organizers may require separate consent from individual members.
2.3. Participants shall not submit material that infringes any copyright, trademark, privacy, publicity, contractual or other third-party right, including in relation to music, photographs, performances, choreography, recordings or trademarks.
3. Rights in Content, Name, Image and Voice
3.1. Participants grant DB Corp, MY FM, Nuvoco and their respective affiliates, agencies, contractors, service providers, media partners and authorised representatives ("Authorised Parties") a worldwide, perpetual, irrevocable, royalty-free, transferable and sub-licensable right and licence, to the fullest extent permitted by law, to use, reproduce, publish, communicate, broadcast, transmit, distribute, display, perform, edit, crop, resize, adapt, modify, translate, subtitle, dub, combine, create derivative works from and otherwise exploit the submitted video and all Campaign-related content.
3.2. This right includes use of the Participant's name, group name, photograph, image, likeness, voice, performance, statements, interviews and other Campaign-related material.
3.3. Such content may be used in whole or part, in any media or format, whether existing now or developed in the future, including radio, television, print, outdoor, websites, applications, social media, digital platforms, promotional videos, advertising, publicity, marketing, brand communication and other Campaign-related or promotional activities.
3.4. The Organizers may use, reuse, edit, adapt, publish or otherwise exploit the content after completion, postponement or cancellation of the Campaign, without further consent or approval, subject to applicable law.
3.5. Participants shall not be entitled to any royalty, licence fee, revenue share, appearance fee, residual payment or other compensation for such use, except the Prize payable to an eligible winner.
3.6. Once any Campaign Content is published, broadcast, uploaded or otherwise made available on any social media, digital or other public platform, it may be copied, downloaded, reposted, shared, embedded or otherwise circulated by third parties and may no longer be within the control of the Organizers. Participants acknowledge that it may not be technically or commercially possible to identify, retrieve or remove every copy or further circulation of such content. Accordingly, to the fullest extent permitted by law, the inability of the Organizers to identify, retrieve, delete or procure the removal of any such content or copy shall not, by itself, constitute a breach of these T&C or any violation of applicable law, provided the Organizers have acted in accordance with applicable law and any mandatory direction of a competent authority.
3.7. Participants agree that, subject to applicable law, publication or use of Campaign Content in accordance with these T&C shall not create any obligation on the Organizers to subsequently recall, delete, withdraw or procure the deletion of such content merely because the Participant subsequently changes his/her mind or withdraws consent. This shall not affect any right or remedy that cannot lawfully be excluded.
4. Personal Data and Privacy
4.1. The Organizers may collect and process personal data including name, contact details, age/date of birth, city, photograph, video, voice, identity/age proof, Aadhar, PAN and payment details.
4.2. Such data may be used for registration, communication, verification, selection, Campaign administration, publicity, Prize disbursement, tax compliance, fraud prevention, record keeping and other Campaign-related purposes.
4.3. Personal data may be shared, where reasonably required, with DB Corp, Nuvoco, their affiliates, agencies, technology and production providers, media partners, payment providers, professional advisers and other persons engaged in conducting or promoting the Campaign.
4.4. The Organizers shall process personal data in accordance with applicable law, including the Digital Personal Data Protection Act, 2023 and applicable rules/regulations. Where consent is the applicable basis, the acceptance of these terms and conditions shall constitute the consent of the participants.
4.5. The rights granted under these T&C shall continue irrespective of completion, postponement, cancellation or termination of the Campaign and shall not be affected merely by any subsequent withdrawal of consent, subject to rights and obligations that cannot lawfully be excluded.
5. Disqualification
5.1. The Organizers may disqualify any Participant or group for false or misleading information, failure to meet eligibility requirements, unverifiable documents, infringement of third-party rights, plagiarism, manipulation of the Campaign or judging process, misconduct, breach of these T&C or violation of applicable law.
5.2. The decision of the Organizers regarding eligibility, selection and disqualification shall be final, subject to applicable law.
6. Judging and Prizes
6.1. Entries shall be evaluated according to criteria determined by the Organizers and/or judging panel. The Organizers may determine the number of shortlisted and participating groups and need not provide individual reasons for selection or non-selection.
6.2. The planned Prize structure is:

6.3. The Organizers may modify, substitute, postpone, withdraw or decide not to award a Prize where reasonably necessary, subject to applicable law. Participation does not guarantee a Prize.
6.4. Winners shall provide PAN, identity proof, address proof, bank/payment details and other documents required for verification and Prize payment. Where a Prize is awarded to a group, payment may be made to the verified Prize recipient/authorised representative, and the Organizers shall not be responsible for disputes regarding distribution of the Prize among group members.
7. Taxes and TDS
7.1. All applicable taxes, duties, levies and statutory charges relating to the Prize shall be borne by the winner/Prize recipient.
7.2. The Organizers shall deduct TDS at the applicable rate, wherever required by law. The applicable rate may presently be 30% for winnings covered by the relevant provisions of the Income Tax law. Accordingly, the amount actually paid may be lower than the gross Prize.
7.3. The winner shall provide PAN and other required documents. The Organizers shall issue the applicable TDS certificate/documentation in accordance with law. No additional amount shall be payable by the Organizers on account of TDS or other taxes.
8. Prize Claim
8.1. Failure to provide required documents, or inability to verify them, may result in disqualification and forfeiture of the Prize.
8.2. If a winner cannot be contacted within 7 days of announcement or fails to complete the Prize claim within the specified period, the Prize may be forfeited and allocated to another eligible Participant through a fresh selection process or otherwise dealt with as permitted by law.
8.3. If a winner dies before completion of the Prize claim process, the Prize shall be dealt with in accordance with applicable law and Campaign rules.
9. Changes, Postponement or Cancellation
9.1. The Organizers may modify the Campaign format, schedule, eligibility, judging process, submission requirements or Prize structure where reasonably necessary.
9.2. The Organizers may postpone, suspend or cancel the Campaign due to insufficient participation, technical or operational reasons, force majeure, regulatory requirements or other circumstances beyond their reasonable control.
9.3. Material changes shall, where reasonably practicable, be communicated to registered Participants. No compensation shall arise solely due to such modification, postponement, suspension or cancellation.
10. Participant Responsibility, Liability and Indemnity
10.1. Participants are responsible for the accuracy of their information, their own equipment/internet access and compliance with applicable law and third-party rights. They shall not misuse, manipulate or interfere with any Campaign platform or system.
10.2. To the extent permitted by law, the Organizers shall not be liable for loss, injury, damage, expense or claim arising from participation or Prize use, or for technical failures, server/network issues, software errors, internet interruptions, hacking, unauthorised access or loss/corruption of submissions.
10.3. The Organizers shall not be responsible for disputes between group members concerning the submitted content or Prize.
10.4. Participants shall indemnify and hold harmless DB Corp, Nuvoco and their respective affiliates, directors, officers, employees, agencies, representatives, contractors and service providers against claims, losses, damages, liabilities, costs and reasonable legal expenses arising from breach of these T&C, false information, lack of required consent, infringement of third-party rights, violation of law, fraud or misconduct.
11. General
11.1. Nothing in these T&C excludes any right or protection which cannot lawfully be excluded.
11.2. These T&C shall be governed by Indian law and, subject to applicable law, courts at Ahmedabad shall have exclusive jurisdiction.
11.3. These T&C constitute an electronic record under the Information Technology Act, 2000 and applicable rules. No physical or digital signature is required where acceptance is recorded electronically.
11.4. Registration or participation constitutes acceptance of these T&C, the Privacy Notice and Campaign instructions.
